NextWeather Terms of Service

These Terms of Service apply to your access to and use of NextWeather Corporation websites and publicly available NextWeather services and materials.
By using the website or services, you agree to these Terms.
Customer Agreements
Use of NextWeather subscription services, software, APIs or other commercial services may also be governed by a separate written agreement between NextWeather and your organization.
If a written customer agreement conflicts with these Terms of Service, the customer agreement controls for the services covered by that agreement.
Decision-Support Information
NextWeather provides weather-related information and decision-support technology.
Weather observations, forecasts and other environmental information involve inherent uncertainty and may change rapidly. Information may originate from third-party sources and may be delayed, incomplete or inaccurate.
NextWeather does not guarantee the accuracy, completeness, availability or timing of any forecast, observation, analysis, alert or other information.
Users remain responsible for their own decisions.
NextWeather should not be used as the sole source for emergency, life-safety or other safety-critical decisions. When conditions may threaten life or property, users should consult the National Weather Service, other appropriate government authorities and applicable emergency procedures.
Professional and Emergency Services
Unless expressly agreed otherwise in writing, NextWeather does not provide emergency response services and does not replace professional meteorological, engineering, safety, legal or other professional judgment.
Third-Party Information
NextWeather may incorporate, display, analyze or reference information provided by third parties.
Third-party information remains subject to the availability, limitations and terms applicable to those sources.
SMS Messaging
Users who enroll in SMS notifications consent to receive operational weather alerts and service-related notifications from NextWeather Corporation.
Message frequency may vary.
Message and data rates may apply.
Reply STOP to opt out or HELP for help.
SMS consent is not a condition of purchasing other NextWeather services unless SMS delivery is specifically part of the service requested.
Acceptable Use
You may not use NextWeather to:
- gain unauthorized access to systems or information;
- interfere with operation of the service;
- introduce malicious code;
- misuse another person's account or information;
- violate applicable law; or
- infringe the rights of others.
Intellectual Property
The NextWeather name, software, applications, websites, designs, text, graphics and other materials are owned by or licensed to NextWeather and are protected by applicable intellectual property laws.
You may not copy, reproduce, modify, distribute, reverse engineer or commercially exploit NextWeather materials except as authorized in writing or permitted by law.
Availability
Weather data, communications networks, third-party services and other systems used by NextWeather may occasionally be unavailable or delayed.
NextWeather does not guarantee uninterrupted or error-free availability of the service or delivery of every alert or notification.
Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTWEATHER SERVICES AND INFORMATION ARE PROVIDED "AS IS" AND "AS AVAILABLE." NEXTWEATHER DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT AND OTHER WARRANTIES NOT EXPRESSLY PROVIDED IN WRITING.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTWEATHER CORPORATION WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM USE OF OR INABILITY TO USE NEXTWEATHER SERVICES OR INFORMATION.
Any additional limitations or remedies applicable to a customer may be stated in that customer's written agreement with NextWeather.
Changes
We may update these Terms of Service from time to time.
Continued use of the website or publicly available services after updated Terms are posted constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles.
Any disputes arising solely under these Terms will be resolved in the courts of San Diego County, California, except where a separate written customer agreement provides otherwise.
